3. Acceptance of Terms
Use of Serenzer constitutes full and unreserved acceptance of these terms and conditions. If you do not accept these terms, you must not create an account or use the service. The publisher may modify these terms at any time; material changes will be notified by email, and continued use of the service following such notification shall constitute acceptance of the amended terms.
4. Description of the Service
Serenzer is an artificial intelligence-based personal assistant designed to help the User organise their personal information. The service enables, among other things, the structuring of ideas and notes, the organisation of projects and tasks, the preparation of a calendar and reminders, the centralisation of information useful in daily life, the tracking of personal routines and the completion of challenges proposed by the coach, and interaction by text or voice through a conversational interface. The service is available in several languages and offers, for certain features, interaction via WhatsApp, available in selected countries only.
5. Limitations of the Service
Serenzer is a functional organisational tool. It does not constitute and does not replace professional advice, whether medical, psychological, legal, financial or of any other nature. Content generated by artificial intelligence may contain inaccuracies or errors; it is the User's responsibility to validate any information before using it to make a decision. For any matter falling within a specialist field, the User is encouraged to consult a qualified professional.
6. Access Conditions and Minimum Age
Use of Serenzer is reserved for adults aged at least eighteen (18) years. By creating an account, you declare that you are of legal age and possess the legal capacity required to accept these terms. The publisher reserves the right to request any appropriate supporting evidence and to close an account if this condition is not met.
7. User Account
Account creation requires the provision of accurate and up-to-date information. The User is responsible for maintaining the confidentiality of their login credentials and for all actions carried out from their account. In the event of unauthorised use, the User must notify the publisher without delay. The publisher reserves the right to suspend or close an account in the event of non-compliance with these terms.
8. Subscription and Payment
Serenzer offers a free trial period as well as paid subscription plans, available on a monthly or annual basis, which renew automatically upon expiry. The free trial period lasts thirty (30) days from the date of account creation and does not require the provision of payment details. This commercial free trial is distinct from the statutory fourteen (14)-day right of withdrawal available, where applicable, to consumers in the European Union for any distance purchase in accordance with applicable regulations; this statutory right of withdrawal applies, where applicable, from the date of effective subscription to a paid plan, irrespective of the duration of the free trial. Payments are processed by Stripe, a secure payment service provider. The User may cancel their subscription at any time from their account; cancellation takes effect at the end of the current billing period and does not entitle the User to a refund for any period already commenced. Applicable pricing is displayed on the website at the time of subscription.
9. Acceptable Use
The User undertakes to use Serenzer in compliance with applicable laws and these terms. The following are expressly prohibited: sharing the account with a third party, circumventing security measures, bulk extraction of data or content, use of the service for unlawful or fraudulent purposes or in a manner that infringes the rights of third parties, and any attempt to disrupt the operation of the service. The publisher may suspend access to the service in the event of a proven breach.
10. Personal Data
Serenzer processes the User's personal data in accordance with the General Data Protection Regulation (GDPR). Conversations, content and information entered by the User are stored on secure servers in order to ensure the operation of the service. Certain processing activities may involve technical sub-processors, including providers of artificial intelligence models, which may entail the transfer of data outside the European Union, governed by the safeguards provided for under the GDPR. The User has the right of access, rectification, erasure, restriction, portability and objection with respect to their data. These rights may be exercised by writing to privacy@serenzer.com. The Privacy Policy sets out all processing activities in detail and forms a supplement to these terms.
11. Intellectual Property
All elements comprising Serenzer (interface, code, trademarks, editorial content, models, resources) remain the exclusive property of Serenzer Limited or its partners. The User retains all rights over the content they enter or import into the service. By using Serenzer, the User grants the publisher a limited, non-exclusive licence strictly necessary for the operation of the service and the provision of the subscribed features.
12. Availability and Maintenance
The publisher shall implement reasonable means to ensure the availability of the service, without however guaranteeing continuous and uninterrupted operation. Maintenance, update or correction operations may result in temporary interruptions. The publisher shall not be liable for unavailability caused by external factors, including those attributable to third-party providers or communication networks.
13. Limitation of Liability
The service is provided on an "as is" and "as available" basis. To the extent permitted by law, the publisher shall not be liable for any indirect damages, loss of data, loss of business or any prejudice arising from the use of or inability to use the service. The publisher's liability shall, in any event, be limited to the amounts actually paid by the User in the twelve months preceding the event giving rise to the loss.

15. Governing Law and Jurisdiction
These terms are governed by Irish law. Any dispute relating to their interpretation or performance shall be submitted to the competent courts of Dublin, subject to the mandatory provisions of the law of the country of residence of consumers within the European Union.
